Recommendation 1997-98-002
ISSUANCE OF CONTRACTS TO REGULAR FULL-TIME FACULTY
WHEREAS, the last contract signed by regular full-time faculty and
the President of the University states:
"16.1 TENURED FACULTY: The University agrees that this contract shall
be renewed annually, subject to the provisions of this paragraph. Reappointment
is subject to the resignation of the Faculty Member, the established retirement
policy of the University as set out in the Faculty Handbook, the continued
ability of the Faculty Member to perform the duties of the Faculty Member,
and the grounds for dismissal for adequate cause specified in the Faculty
Handbook. In addition, reappointment is subject to provisions under which
faculty may be placed on indefinite leave without pay if reduction in faculty
becomes necessary under extraordinary circumstances because of demonstrated
bona fide financial exigency, after reasonable notice, and in accordance
with established policies and procedures which will be set out in the Faculty
Handbook."
and,
"24.2 AMENDMENT IN WRITING ONLY: Faculty Member and the University
agree that this contract may be altered, amended or changed only by a written
agreement between Faculty Member and the University."
AND WHEREAS, Section 2.3.d (page 21) of the Faculty Handbook 1987
states:
"[2.3.]d. Contractual Conditions
"Contracts shall be issued to all academic personnel, full-time or
part-time, by the appropriate University officer. These contracts shall
specify academic rank and/or title, salary, tenure status (if appropriate),
and duration for all academic appointments and the Tenure Decision Date
(where appropriate). Any other conditions or limitations of employment
also shall be given. The Provost shall issue annual contracts to all regular
full-time faculty. Vice-presidents and deans shall issue contracts to all
other faculty giving the title, salary, and terms of the appointment. No
full-time or part-time academic employee is considered to have faculty
status unless the President or appropriate vice-president or dean has signed
a written contract for that employee."
"Whenever possible, contracts shall be issued and delivered to all
continuing faculty by May 1. Faculty members shall sign and return their
annual salary contracts to the Provost's Office no later than the start
of the contract period (normally the beginning of the academic or fiscal
year) if they agree to the terms of the contract."
AND WHEREAS, regular full-time faculty of the University of Southern
California, including regular full-time faculty in the School of Medicine
of the University, have not yet received from the Provost contracts for
the current academic year; therefore,
According to the Governance Document (1997) of the School of Medicine,
the Medical Faculty Assembly makes this Recommendation to the Dean, with
a copy to the FEC:
The Medical Faculty Assembly recommends that the Dean:
1. Recommend to the Provost that the Provost issue contracts by November
1, 1997 to the regular full-time faculty of the University, including its
School of Medicine, and
2. Recommend to the Provost that the Provost work with faculty to devise
methods that will facilitate the issuance of future contracts by May 1
of each year.
3. Inform the Provost that the Faculty of the School of Medicine:
A. Reaffirms its commitment to Section 2.3.d of the 1987 Faculty Handbook.
B. Views the failure of the Provost to issue contracts to regular full-time
faculty in a timely fashion to be a matter of grave concern.
